New Distracted Driving Ordinance
On July 12, 2010, the City of Troy passed their proposed “Distracted Driving†Ordinance. This ordinance is comprised of language used in similar ordinances across the country where the use of hand-held electronic devices, including cell phones, is banned. The new ordinance prohibits three types of distracted driving behaviors.
The first type prohibits any activity necessary to or associated with the use of a two-way wireless electronic communication device for the purpose of sending or receiving text messages while driving a motor vehicle.
The second type prohibits any activity necessary to or associated with the use of a hand held wireless electronic device for the purpose of sending or receiving voice messages while driving a motor vehicle (hands free device permitted).
The third type prohibits any other activity that distracts a driver, such that results in a failure to use due care and caution in the safe operation of a motor vehicle. Examples include, eating, grooming, reading, writing, or (more…)
