Super Drunk Driving Law
Effective October 31, 2010, you could face increased sanctions if convicted of operating a motor vehicle with a blood alcohol content (BAC) of 0.17 or greater. Among the enhanced sanctions faced by time offenders convicted of operating a motor vehicle with a BAC of 0.17 or greater are:
- Driver’s license suspension for one year with eligibility for a restricted driver’s license after 45 days;
- Installation of a Breath Alcohol Ignition Interlock Device (BAIID) as a condition of a restricted driver’s license;
- Mandatory alcohol treatment or self-help program for a period of not less than one year;
- Increase in the maximum fine amount from $500.00 to $700.00;
- Increase in the maximum period of incarceration from 93 days to 180 days in jail;
